This paper addresses some considerations regarding the deterrent effect of the current private and public legal instruments applicable to unlawful conduct of companies. By going through the facts which are at the basis of the well-known Dieselgate case, it is possible to determine that the available remedies and system of sanctions provided for in the unfair commercial practices regime, taken as a whole, appear inadequate for the purpose of deterrence. From the author’s point of view, these limitations cannot be overcome as long as the civil liability regulations remain confined to a model that provide for the recovery of compensatory damages without introducing more effective legal tools that allow disgorgement of profits from the offender of a wrongful conduct.
Nel presente contributo sono svolte alcune considerazioni in merito alla efficacia dissuasiva degli strumenti di diritto privato e di diritto pubblico in relazione alle condotte illecite messe in atto dalle imprese a scopo lucrativo. Ripercorrendo i fatti che hanno dato origine al noto caso Dieselgate si constata come il sistema rimediale e sanzionatorio predisposto dalla disciplina sulle pratiche commerciali scorrette, complessivamente inteso, appare inadeguato sotto il profilo della deterrenza. Tale limite non sembra superabile, nella prospettiva dell’autore, fintanto che la responsabilità civile rimarrà confinata nel modello compensatorio e non saranno previsti rimedi più incisivi che obblighino l’autore della condotta illecita alla restituzione degli utili.
