In this contribution, Franchini deals with the implicit term obligation, now regulated by art. 1183 cc. In roman experience, the theme is important not so much for the relationships protected by iudicia bonae fidei, in which more emphasis is placed on concrete behaviors and reciprocal trusts between the parties, but rather for relations arising from stipulation that, missing an express term, it could be considered, at times, subject to an implicit term, to be identified first, even though different criteria, so that the possible delay in the fulfillment would be imputed exclusively to the expiration of it. The author also investigates the problem of the foundation of the term, found in the natura rerum or in a underlying conventio, in the framework of roman ius controversum, distinguishing between the various types of analyzed performance: to certo loco dare, to insulam aedificare or other.
In questo contributo Franchini tratta dell’obbligazione soggetta a termine implicito, disciplinata oggi dall’art. 1183 cc. Nell’esperienza romana il tema rileva non tanto per i rapporti tutelati da iudicia bonae fidei, per i quali si aveva più che altro riguardo agli affidamenti creatisi tra le parti, anche in considerazione dei comportamenti concretamente adottati, quanto piuttosto per i rapporti nati da stipulatio, la quale, in mancanza di dies espresso, poteva essere talora ritenuta soggetta ad un termine implicito, da individuarsi a priori, pur secondo criteri diversi, cosicché l’eventuale ritardo nell’adempimento fosse imputato esclusivamente alla scadenza di quello. Anche il problema del fondamento del termine, rinvenibile nella natura rerum ovvero nella conventio sottostante, è indagato dall’autore, nel quadro del ius controversum romano, distinguendo tra i vari tipi di prestazione studiata: di certo loco dare, di insulam aedificare o di altro genere.
